Class Action Status

Oberschlake v. St. Joseph's Hospital:

The Court granted Final Approval of the Class Action Settlement on September 20, 2011. This is great news as the settlement is legally considered final as of December 22, 2011. If you made a valid and timely claim you can expect your share of the settlement payment to be mailed on or about January 6, 2012. If you do not receive your settlement check by January 13, 2012, please contact our office. Furthermore if you move or relocate, please provide our office with your current address.

We are happy to announce that the Pate v. Children’s Hospital of Orange County and the York v. Children’s Hospital of Orange County matters have settled and that the Court has granted Preliminary Approval of the class action settlement on August 18, 2011. The Notice of the Settlement ("Notice") and claim form were mailed to the Class on September 16, 2011. (Those individuals who were 12 hour employees and did not opt out of the class during the original notice period.) After the claims process ends, the plaintiffs will file a motion for Final Approval. The Final Approval hearing before Judge Andler is set for December 15, 2011. It is not necessary for the Class Members to appear at the hearing.

It is important that every class member submit a timely proof of claim form (POC) in order to be paid under the terms of the settlement. This means that each class member must timely submit a POC postmarked no later than October 31, 2011 and keep a current address on file with our office and/or the Claims Administrator. Please contact our office if you have not received your settlement notice and claim form.

Brinkley v. Public Storage:

The Court of Appeal issued a ruling that agreed with the trial court's summary judgment in favor of Public Storage. As such, on December 4, 2008 the plaintiff, Mr. Brinkley, on behalf of himself and the class of employees, filed a Petition for Review with the California Supreme Court. The Supreme Court has agreed to review the Court of Appeal ruling on a "grant and hold" basis pending its opinion on a companion case of Brinker v. Superior Court (Hohnbaum),(2008) 165 Cal. App. 4th 25. As such, this means that the Brinkley v. Public Storage class action is stayed until the Supreme Court issues its ruling in Brinker. The Brinker matter is fully briefed and the Supreme Court heard oral arguments in the Brinker matter on November 8, 2011 at 9:00 a.m. As such, an opinion can be excepted no later than Monday February 6, 2012. Tien/McDonough v. Tenet:

This matter is currently stayed pending the Supreme Court's decision in a similar matter entitled Brinker v. Superior Court (2008)165 Cal.App.4th 25, which will affect the Tien action as to the meal and rest breaks. At this time the Supreme Court heard oral arguments in the Brinker matter on November 8, 2011 at 9:00 a.m. As such, an opinion can be excepted no later than Monday February 6, 2012. Methodist Hospital of Arcadia:

The Court granted Final Approval of the Class Action Settlement on November 12, 2008. If you made a valid and timely and claim your first settlement payment was mailed on or about May 2009. Furthermore the second payment was sent on January 19, 2012.

According to the Court approved settlement Methodist is required to pay to the Claims Administrator as follows:

The first settlement payment of $2 Million dollars to the Claims Administrator by March 13, 2008 such that the first payment to class members who made a timely and valid claim was mailed on or about April 13, 2009. The remainder of the payment mailing schedule is set forth below as follows:

First payment made $2M, second payment made $4M.

  • Third payment of $4M to Claims Administrator on or before December 31, 2012
  • Fourth payment of $4M to Claims Administrator on or before December 31, 2013
  • Fifth payment of $4M to Claims Administrator on or before December 31, 2014 and
  • Final Payment of $537,230.89 to Claims Administrator on or before 12/31/2015

The Claims Administrator will have 30 days to input, process, and mail all checks to class members who made valid and timely claims. If you do not receive any payment by February 10 th of 2012, 2013, 2014 or 2015, please contact our office.

If you have a change of address from this date forward, until the final payment in 2015, please contact our office and/or the Methodist Hospital Claims Administrator with your new address to ensure you are in receipt of your payments. The claims administrator can be reached at:
